PRIVACY POLICY
As a business consulting provider, Nihon M&A Center Singapore Pte. Ltd. (NMA) and its group companies (collectively “NMA Group”, “us, “we” or “our”) collect business information for the purpose of serving the needs of clients. In some situations, we may need to collect personal information from representatives of companies that engage and/or receive our services. This Privacy Policy may be made in or translated to other language than English. The English version of this Privacy Policy shall prevail if there is a conflict.
This is the Privacy Policy of NMA that sets out how we collect, use, disclose and protect the data, whether true or not, about an individual who can be identified either (a) from that data; or (b) from that data and other information to which we have or are likely to have access (“Personal Data”) that you provide to us during business and service (including preliminary service) relationship. This Privacy Policy applies to all clients or potential clients and service providers of NMA and is designed to meet the requirements of the Personal Data Protection Act 2012 of Singapore (“PDPA”).
Please take a moment to read this Privacy Policy before giving any information requested by us, so that you are aware of and understand the purposes for which we process, collect, use and disclose your Personal Data.
From time to time, we may review and update this Privacy Policy to ensure that it is consistent with any changes in legal requirements. We encourage you to check with us (and our global website as and when necessary, from time to time) for any updated versions of the Privacy Policy that is posted, and date stamped so that you are aware of when the Privacy Policy was last updated.
TYPES OF PERSONAL DATA WE COLLECT
The types of the Personal Data that we collect or you submit depend on the conditions and circumstances of collection and the nature of the transaction undertaken or to be undertaken with us.
The Personal Data that we may collect includes but is not limited to:
- personal identification information, including name, identification and passport numbers, gender, date of birth, images, photographs, videos, voice recordings.
- contact information, including postal address, email address, phone number.
- demographic information, such as academic qualifications, occupation, job details, salary information, other information as we may notify you, whether for surveys, inquiry to us.
- usage data, which includes information about how you use our website (including the time you visit our website, the duration of your visit).
- marketing and communications data, which includes your interests, feedback, survey responses, preferences in receiving marketing materials from us and your communication preferences, as well as your preferences for particular products or services.
- technical data, which includes your Internet Protocol (IP) address, the internet device identity or media access control address of your device, information regarding the manufacturer, model or operating system of the device that you use and/or information about the web browser that you use to access our website.
HOW WE COLLECT PERSONAL DATA
Any Personal Data held by us will be committed to a high degree of protection. The following are the ways that we collect your data;-
Online: direct email communication with our employees, HR personnel, contact us via our global website, application for or enquiry about our website, participate in a promotion, survey, event or other marketing campaign organised by us, subscribe to our newsletters or alerts, request marketing materials to be sent to you; and
Offline: event and seminar organized by us or co-organized by us and other companies, other campaigns attended by us, physical meeting with our employees, and general phone calls.
WHAT WE DO WITH YOUR PERSONAL DATA
The Personal Data we request, and/or you provide to us is necessary for us to process transactions, understand your needs, maintain our relationship with you, fulfil our delivery obligations for any services you undertake with us, and improve our service delivery. In particular, we collect and use your Personal Data for any or all of the following purposes:
- To verify your identity
- To manage your account
- To manage our relationship with you including but not limited to replying to your inquiries
- To administer, operate, provide, maintain and protect our business and our website (including troubleshooting, data analysis, testing, system maintenance, support, reporting and hosting of data, as well as ensuring that unauthorised users do not access the information on our website)
- To deliver relevant content and advertisements to you and measure or understand the effectiveness of the advertising we serve you
- To make suggestions and recommendations to you about products or services that may be of interest to you
- To send you relevant information about our events, news announcements or promotions
- To enable you to complete a survey or participate in a promotion, survey, event or other marketing campaign organised by us

- For our operation and engagement
- Aid our research and analysis, generate information material for search of potential corporate partnership candidates.
- Assist due diligence process for you.
- Comply with all laws and obligations from any authorities.
- Any other purposes for which you have provided the information
- Any other incidental business purposes related to or in connection with the above
The purposes listed above may continue to apply even in situations where your relationship with us (for example, pursuant to a contract) has been terminated or altered in any way, for a reasonable period thereafter (including, where applicable, a period to enable us to enforce our rights under any contract with you).
We may also use and disclose your Personal Data within NMA Group, and with and to third parties in respect of the said purposes. In order to fulfill the purposes listed above, in which case, we may:
Disclose or transfer your Personal Data to and, jointly and/or severally use your Personal Data with such other parties (including other entities within the NMA Group) in Singapore and overseas (including Japan), and your Personal Data may also be transmitted to data storage facilities or our offices and appointed service providers or other countries (including Japan) in connection with our performance of the transaction with you. We shall ensure that your Personal Data continues to receive a standard of protection that is at least comparable to that provided under the PDPA. You acknowledge and consent that your Personal Data may be transferred to or shared in the server managed by NMA Group located in Japan. The Personal Data so transferred or shared in the server managed by NMA Group located in Japan shall be treated strictly in accordance with the security system which has obtained ISMS (ISO27001) certification.
Share your Personal Data with our trusted partners to help us perform statistical analysis, send you email or postal mail, or arrange for deliveries. All such third parties are prohibited from using your Personal Data except to provide these services to us, and they are required to maintain the confidentiality of your Personal Data and provide a standard of protection that is comparable to the protection under the PDPA.
CONSENT
Your express consent will be sought when collecting your Personal Data. There will also be instances where your consent for the collection or use of your Personal Data will necessarily be implied from the circumstances by nature of the task or transaction, including your interaction with us or in the course of signing for, or accepting, any of our services you have requested.
Where you are supplying the Personal Data of another individual (e.g. information of your employees, etc.), you represent, warrant, undertake and will ensure that the individual whose Personal Data is supplied to us has consented to provide us with their Personal Data for the respective purposes, and is informed of and consents to the terms of this Privacy Policy.
This Privacy Policy shall supplement any other policies that you may have previously provided consent to us in respect of your Personal Data.
ACCESS
Subject to the relevant restrictions under the PDPA, we will, upon your written request to our Data Protection Officer (see contact details and requirements below), allow you to (i) enquire about your Personal Data that is in our possession or under our control and (ii) enquire about the ways in which your Personal Data has been or may have been used or disclosed within a year before the request. Where required or authorised to do so by law, we reserve the right to charge a reasonable administrative fee for this service and/or deny your request for access to your Personal Data.
RETENTION
We will retain your Personal Data for as long as it is necessary to fulfil the purpose for which it was collected, the legal or business purposes of NMA, or as required by relevant laws. When destroying Personal Data, we will take commercially reasonable and technically possible measures to make the Personal Data irrecoverable or irreproducible in accordance with the applicable laws. In some circumstances we may anonymise your Personal Data (so that it can no longer be associated with you) for research or statistical purposes in which case we may use this information indefinitely without further notice to you.
SECURITY
We are committed to ensuring the security and protection of your Personal Data in our possession or our control by making reasonable security arrangements to prevent unauthorised access, collection, use, disclosure, copying modification, disposal or similar risks. For example:
Access to personally identifiable information is only provided to our directors and employees on a need-to-know basis and stored in access restricted folder.
While we strive to protect your Personal Data, we cannot completely guarantee the security of any Personal Data we may have collected from or about you, or that no harmful code will enter our IT system (for example viruses, bugs, trojan horses, spyware or adware). You should be aware of the risks associated with disclosing any information over the Internet and we urge you to take every precaution when using the Internet to disclose your Personal Data to us, including using strong passwords and using a secure browser.
HOW WE USE COOKIES
